ACCEPTABLE USE POLICY

CONSEQUENCES

ICServices retains the right, but not the obligation, at its sole discretion and without prior notice or liability, to restrict and/or terminate a clients access to or presence on ICServices equipment or services if, in the opinion of ICServices, the clients use of its services violates any applicable law or regulation, or ICServices Acceptable Use Policy (AUP), or whose activities in any fashion are considered by ICServices to be harmful to ICServices' reputation and business prospects.

ICServices reserves the right to suspend any client services pending investigation of a complaint about copyright violation, SPAM or any other violation of law or ICServices' AUP, and to leave such services off until the investigation is completed to ICServices' satisfaction. In the event ICServices determines that the client did violate the AUP or any applicable law, service may be terminated permanently without refund.

In addition, any client whose presence on our Web servers causes embarrassment, harm to ICServices business reputation, or creates problems with our service providers, even if there is no specific violation, may be asked to find another host, with or without notice and with or without refund, as determined by ICServices depending upon the circumstances.

ICServices reserves the right to remove any and all materials which infringe on copyrighted work. Such materials may be removed at any time upon receiving a complaint and/or notice of alleged copyright infringement.

ICServices considers the practices outlined in section 3 "Use Restrictions" to constitute abuse of our service. Therefore, these practices are prohibited by ICServices terms and conditions of service. Engaging in one or more of these practices may, at the discretion of ICServices, result in immediate termination of the offender's account and/or access to ICServices services.

In addition, ICServices reserves the right, where feasible, to implement technical mechanisms which block or restrict a client's access to services during times of dispute of while reports of offenses are being investigated.

Nothing contained in this policy shall be construed to limit ICServices' actions or remedies in any way with respect to any of the foregoing activities, and ICServices reserves the right to take any and all additional actions it may deem appropriate with respect to such activities, including without limitation taking action to recover the costs and expenses of identifying offenders and removing them from the ICServices service, and levying cancellation charges to cover ICServices' costs in the event of disconnection of dedicated access for the causes outlined above. In addition, ICServices reserves at all times all rights and remedies available to it with respect to such activities at law or in equity.
